求翻譯：目前，法律實(shí)務(wù)界對(duì)于未經(jīng)審批境外影視作品的著作權(quán)保護(hù)問(wèn)題的處理意見(jiàn)不統(tǒng)一，導(dǎo)致同類(lèi)案件的判決差異較大，集中體現(xiàn)在對(duì)涉訴影視作品賠償損失責(zé)任的認(rèn)定方面。本文立足于我國(guó)的立法現(xiàn)狀和實(shí)際國(guó)情，在權(quán)衡行政審批制度和民事著作權(quán)侵權(quán)糾紛處理的基礎(chǔ)上，基本肯定第三種審判思路，并且建構(gòu)性的提出了針對(duì)境外影視作品的事后審批制度，以及境外影視作品集體管理的法律規(guī)制，以期為有效解決此類(lèi)問(wèn)題提供理論范式和實(shí)踐參考。是什么意思？ 待解決
